GOODSOUL LLC CUSTOMER, INTELLECTUAL PROPERTY and WAIVER

AGREEMENT

This agreement is intended to explain GOODSOUL LLC (USA)’s ways of doing business, to protect its rights and values, and to prevent disputes that may arise.

By signing this agreement, I ACCEPT the following provisions in advance, with my own consent, unconditionally.

OPERATING CONDITIONS:

Article 1 – Goodsoul LLC is an organization serving the whole world from America. Its field of study is awareness, personal development and coaching. All of the materials and methods used while providing the service are specially developed and unique. Therefore, all of the materials used are the intellectual right of Goodsoul LLC and is confidential.

Article 2- I know that the services I receive from Goodsoul LLC and its workers, are not related to the services received from doctors, psychologists, psychiatrists, therapists and other health institutions. At the same time, I undertake that I do not have a condition that requires such treatment.

Article 3- I undertake that I have read the working protocols on www.goodsoul.net , understand and apply them exactly.

Article 4- I accept that the service provided is an hourly service and that the fee has been notified to me before receiving the service, that I have accepted the service fee, that I have paid in advance and that there is no refund.

Article 5- I accept that the time appointed to me is the time allocated for me, I undertake that I will not make a request to extend this period of time and if I do not receive the service in the time allocated to me, I will pay the fee for this period in any case.

Article 6- I agree that the service I have received from Goodsoul LLC can be stopped without any notice unconditionally. I agree that I will not hold any rights or claims in such a case.

Article 7- I agree in advance that I will observe the personal rights of Goodsoul LLC or its employees, that I will not try to contact them by e-mail, telephone or in person outside of service hours, and will not send gifts. In such a case, I accept that I know that the service will be stopped unconditionally and indefinitely.

CONFIDENTIALITY AGREEMENT:

Article 8- I accept that I will not disclose any information about the service I have received to third parties or other customers, nor will I imitate them myself, and that I know that if I do not comply with these conditions, this is a violation of the copyright of the service provider and GOODSOUL LLC and is against the law.

Article 9- I accept that I will not engage in such activities as I know that the audio/film and any written content I use is the property of Goodsoul LLC and that it is clearly forbidden to share and reproduce.

Article 10- I understand that I have consciously chosen the audio/film and written materials I use and that there is no illegal or fraudulent situation. I undertake that I will not hold the service provider or Goodsoul LLC responsible for any damages that may arise from these.

DISCLAIMER OF ACTIVITY:

Article 11- When I agree to receive services from Goodsoul LLC, I agree and undertake not to sue on behalf of myself, my heirs, personal representatives, attorneys, including the negligence of Goodsoul LLC company, its owner, employees, agents.

Article 12- I hereby release Goodsoul LLC forever from liability to its company, owner, employees and agents for all claims, demands, actions and liabilities I may have as a customer

Article 13- Goodsoul LLC is exempt from all injuries, accidents, illnesses and property losses resulting from, but not limited to, my participation in the service provided. I accept that I will not hold the company, its employees and owners responsible in any way and I will not sue.

Article 14-The waiver and release mentioned above apply to my disability, personal injury, property theft, property damage, and all losses related or unrelated to the service. It also covers all accidents and injuries that may occur while receiving or arriving at or leaving service place.

Article 15- I accept and undertake that I have paid the fee for the service I received in advance and that I know that it will not be refunded under any circumstances.

Article 16- In the event that some of the provisions of this agreement are deemed invalid by the courts of Turkey or the USA, I accept that the other provisions of the agreement will be applicable and I will be responsible for the remaining part.

This agreement will start on the following date with the signature of both parties as 16 articles and will continue indefinitely.

GOODSOUL LLC MÜŞTERİ, FİKRİ MÜLKİYET HAKKI ve İBRANAME

ANLAŞMASI

Bu sözleşme GOODSOUL LLC (USA)’in iş yapış şekillerini anlatmak, haklarını ve değerlerini korumak, ve ortaya çıkabilecek anlaşmazlıkları önlemek amaçlıdır.

Bu anlaşmayı imzalamak sureti ile aşağıda yazılan hükümleri peşinen, kendi rızam ile koşulsuz olarak KABUL EDERİM.

FAALİYET KOŞULLARI:

Madde 1 – Goodsoul LLC Amerika’dan tüm dünyaya hizmet veren bir kuruluştur. Çalışma alanı bedensel farkındalık, kişisel gelişim ve koçluktur. Hizmeti verirken kullanılan materyal ve yöntemlerin tümü özel olarak geliştirilmiş ve tektir. Bundan dolayı Goodsoul LLC’in fikri ve sınai hakkıdır ve gizlidir.

Madde 2- Goodsoul LLC’den, burada çalışan kişilerden, aldığım hizmetlerin doktorluk, psikologluk, psikiyatristlik, terapistlik ve diğer sağlık kurumlarından alınan hizmetlerle ilgisinin olmadığını biliyorum. Aynı zamanda böyle bir tedaviyi gerektiren bir durumum olmadığını taahhüt ederim.

Madde 3- www.goodsoul.net de bulunan çalışma protokellerini okuduğumu ve bunları anladığımı ve birebir uyguladığımı tahahhüt ederim.

Madde 4- Verilen hizmetin saat bazlı bir hizmet olduğunu ve ücretinin tarafıma hizmet almadan önce bildirildiğini, hizmet ücretini Kabul ettiğimi, peşin olarak ödediğimi ve iadesinin de olmadığını kabul ederim.

Madde 5- Tarafıma bildirilen zaman diliminin, bana ayrılan sure olduğunu Kabul eder, süreyi uzatmak adına talepte bulunmayacağımı ve bana ayrılan sürede hizmeti almaz isem bu sürenin ücretini her halükarda ödeyeceğimi tahahhüt ederim.

Madde 6- Goodsoul LLC’den aldığım hizmetin gene tek taraflı olarak hiçbir koşula dayanmadan durdurabileceğini Kabul eder. Böyle bir durumda hiçbir hak veya iddiada bulunmayacağımı Kabul ederim.

Madde 7- Goodsoul LLC’nin veya çalışanlarının kişisel haklarını gözeteceğimi, hizmet saatleri dışında e-mail, telefon veya şahsen irtibata geçmeye çalışmayacağımı, hediye göndermeyeceğimi peşinen Kabul eder. Böyle bir durumda hizmetin koşulsuz ve süresiz kesileceğini bildiğimi Kabul ederim.

GİZLİLİK SÖZLEŞMESİ:

Madde 8- Aldığım hizmet ile ilgili herhangi bir bilgiyi üçüncü kişilere veya diğer müşterilere anlatmayacağımı, aynı zamanda kendim taklit etmeyeceğimi, bu koşullara uymadığım takdirde bunun hizmet verenin ve GOODSOUL LLC’nin telif haklarının ihlali olduğunu ve kanunen cezası olduğunu bildiğimi Kabul ederim.

Madde 9- Kullandığım sesli/film ve yazılı her türlü içeriğin Goodsoul LLC’nin mülkiyeti olduğunu ve açıkça paylaşılmasının, çoğaltılmasının yasak olduğunu bildiğimi bu tip faaliyetlerde bulunmayacağımı Kabul ederim.

Madde 10- Kullandığım sesli/film ve yazılı materyalleri bilinçli olarak kendim seçtiğimi ve bununla ilgili herhangi bir yasadışı veya hileli bir durum olmadığını anladığımı. Bunlardan gelebilecek zararlar ile ilgili hizmet vereni veya Goodsoul LLC’yi sorumlu tutmayacağımı tahattüt ederim.

FAALİYET FERAGATNAMESİ:

Madde 11- Goodsoul LLC’den hizmet almayı Kabul ettiğim anda, kendim, mirasçılarım, kişisel temsilcilerim, vekillerim adına Goodsoul LLC şirketinin, sahibinin, çalışanlarının, acentelerinin ihmali de dahil olmak üzere dava etmemeyi Kabul ve taahhüd ediyorum.

Madde 12- Goodsoul LLC’yi , şirketine, sahibine, çalışanlarına ve acentelerine karşı müşteri olarak sahip olabileceğim tüm iddialar, talepler, eylemler ve yükümlülükler için sorumluluktan sonsuza kadar muaf tutuğumu bildirirm

Madde 13- Verilen hizmete katılımımdan kaynaklanan ancak bununla sınırlı olmayan yaralanmalar, kazalar, hastalıklar ve mal kayıplarının tümünden Goodsoul LLC’ muaftır. Bunlarla ilgili şirketi, çalışanlarını ve sahiplerini hiçbir şekilde sorumlu tutmayacağımı ve dava açmayacağımı Kabul ederim.

Madde 14-Yukarıda belirttiğim feragat ve ibra, sakatlığım, kişisel yaralanmam, mülk hırsızlığım, mülk hasarım ve hizmet ile ilgili veya ilgisiz olan tüm kayıplarım için geçerlidir. Aynı zamanda hizmet alırken veya hizmet almaya gelirken veya çıkışında olabilecek tüm kazalar ve yaralanmaları da kapsar.

Madde 15- Aldığım hizmetin ücretini peşin ödediğimi ve hiçbir koşulda iadesinin de olmayacağını, kişisel verilerimin işlenmesini Kabul ve taahhüt ederim.

Madde 16- Bu anlaşmanın hükümlerinin bazıları Türkiye veya Amerika mahkemeleri tarafından geçersiz sayıldığı durumda anlaşmanın diğer hükümlerinin yürüklükte olacağını Kabul eder ve kalan kısmından sorumlu olacağımı Kabul ederim.

İşbu anlaşma 16 madde olarak iki tarafın imzası ile aşağıdaki tarihte yürürlüğe girecek ve süresiz olarak devam edecektir.
